How We Share Your Personal Data

We disclose your Personal Data to the categories of service providers and other parties listed in this section. Depending on state laws that may be applicable to you, some of these disclosures may constitute a “sale” of your Personal Data. Legal Obligations

By using or accessing our Services in any manner, you acknowledge, you acknowledge that, we may share any Personal Data that we collect with third parties in conjunction with any of the activities set forth under “Meeting Legal Requirements and Enforcing Legal Terms” in the “Our Commercial or Business Purposes for Collecting Personal Data” section above.

Business Transfers

All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.

Data that is Not Personal Data

We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.  

Tracking Tools, Advertising and Opt-Out

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). Please note that because of our use of Cookies, the Services do not support “Do Not Track” requests sent from a browser at this time.

Information about Interest-Based Advertisements:

We may serve advertisements through the Services and on third party sites. Data Security and Retention

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. Although we work to protect the security of your data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure,  and you provide this information at your own risk.

ACCORDINGLY, WE DISCLAIM LIABILITY FOR THE THEFT, LOSS OR INTERCEPTION OF, OR UNAUTHORIZED ACCESS OR DAMAGE TO, YOUR DATA OR COMMUNICATIONS BY USING THE SERVICE.  YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND ASSUME THESE RISKS.

To the maximum extent allowed by applicable law, you agree and acknowledge that we will not be liable or responsible if any information about you is intercepted, accessed, and/or used by an unintended recipient.  You agree that you will contact and notify us immediately if you have reason to believe that the security of your Personal Data has been compromised.

We retain Personal Data about you for as long as necessary to provide you with our Services. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain certain information (e.g., usage data) in an anonymous or aggregated form where that information would not identify you personally.

Personal Data of Children

Our Services are not intended for use by children under the age of 13. As noted in the Terms of Use, we do not knowingly collect or solicit any personally identifiable information (as that term is defined in the Children’s Online Privacy Protection Act) about children under 13  years of age; if you are a child under the age of 13, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 13 years of age, we will delete that information as quickly as possible. We do not knowingly process Personal Data of EU residents under the age of 16 without the consent of a parent or legal guardian.  If we become aware that we have collected Personal Data from an EU resident under the age of 16 without parental consent, we will take reasonable steps to delete it as soon as is practicable.

Protected Health Information – HIPAA

We are not a health plan, healthcare clearinghouse or healthcare provider, or otherwise a “covered entity” as defined or contemplated by The Health Insurance Portability and Accountability Act of 1996, as amended (HIPAA).  You acknowledge and agree we are not obligated to comply with HIPAA rules requirements regarding privacy and security of “Protected Health Information” (ePHI) that we may be provided pursuant to your use of the Service. You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including HIPAA. If we become aware that you have transmitted ePHI in any manner through the Service in violation of this Agreement or HIPAA, you acknowledge and agree that: (a) we may delete the ePHI without notice to you and without us incurring any liability to you, and (b) you agree to pay any costs or fees associated with that ePHI deletion.

California Resident Rights

According to CalOPPA we agree to the following:

Please note, you are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 months.

(b)  To delete your personal information. If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.

(c)  To stop selling your personal information.  If you are a California resident, you may opt-out of the sale of your personal information.

(d)  To stop sharing your personal information.  If you are California resident, you may opt-out of the “sharing” of your personal information (defined as the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across websites).

Please note, if you ask us to delete or stop selling your personal information, it may impact your experience with us, as you may not be able to participate in certain aspects of the Service which require the usage of such Data to function. However, we will not discriminate against you for exercising your rights.

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. Privacy Notice for Connecticut Residents

Pursuant to Connecticut General Statutes Section 42-471, it is our policy to protect the privacy of your personal information by doing the following:  Safeguarding any data, computer files and documents containing your personal information from any misuse by third parties; Destroying, erasing or making unreadable any data, computer files and documents containing your personal information prior to their disposal; Protecting the confidentiality of your Social Security number and other personal information; Prohibiting the unlawful disclosure of your Social Security number and other personal information; Limiting and/or restricting access to your Social Security number and other personal information to other third parties; and Limiting the access of your Social Security number and other personal information only to our employees who need access to your personal information to allow us to provide services to you, limiting the access of these employees to the extent needed, and otherwise imposing restrictions and reasonable safeguards on our employees to prevent them from accessing your personal information.

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by posting the new Privacy Policy on this page, by placing a notice on the UnitX website, by sending you an email and/or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them.
